Summary

This manual will be an annually updated guide to leniency programmes across the world - leniency programmes being the means by which a cartel participant can gain immunity from, or a reduction in, penalties, in return for blowing the whistle on a cartel. In recent years cartel regulation has become a key priority for competition authorities around the globe resulting in a proliferation of immunity and leniency programmes, hence an increasing need to keep abreast of developments in this rapidly evolving area. Competition authorities are constantlydeveloping and revising their approaches to cartel regulation and introducing new mechanisms for businesses to report cartels, seek immunity and gain leniency. The need for businesses and their advisers to be able to identify and manage their global risk exposure is more pressing than ever before. This book addresses this pressing need by providing a detailed guide to leniency programmes across the world containing practical, accessible and comprehensive information on each country's leniency programme, for competition law practitioners and corporate counsel. The Manual draws on Baker andMcKenzie's global network of experienced practitioners who have extracted practical and substantive information presented in an accessible and user-friendly format. The level of detail - in particular for smaller, more obscure jurisdictions - is unrivalled and enables practitioners to rapidly assessthe requirements for submitting an application for leniency in any of the jurisdictions covered. The consistent format of the country chapters allows for ease of reference and facilitates comparison of the advantages and disadvantages of submitting an application in each regime. This is furtherhelped by inclusion of a quick reference guide, in the form of a tabular country-by-country overview of the leniency programmes in place around the world, at the front of the manual. Unique in terms of its geographical reach, the manual also contains an introductory overview from the editors offerssome comparative analysis and highlights any key developments in any of the regimes that should be taken into account.
