Summary

This handbook highlights the critical differences that frequently exist between the law applicable to state and local public works versus private works so that owners, contractors, subcontractors and design professionals can avoid the many pitfalls and surprises that can arise due to such differences. Although the law of each state or local jurisdiction may vary in its particulars, there are a number of common differences between the law applicable to public and private projects. Familiarity with such differences enables those providing legal advice to participants on public projects and the participants themselves to better understand and discern the particular requirements of their state or local jurisdiction and how it differs from those applicable to private construction projects.

Author Biography

Daniel D. McMillan is a partner in the Los Angeles office of Jones Day and is co-chair of the firm's international construction practice, which was recognized by Chambers USA as the Construction Practice of the Year for 2017. Mr. McMillan represents owners, design professionals, and contractors in large construction disputes and in negotiating and drafting contracts. He has dealt with all types of project delivery systems and construction and engineering claims. Mr. McMillan has extensive trial and appellate experience, as well as broad experience with domestic and international arbitration proceedings. As trial and appellate counsel, Mr. McMillan represented the owner in the first case to result in a published court decision in the United States involving disputes review boards. Mr. McMillan has worked on projects throughout the United States and across the globe for clients like Chevron, AECOM, Kiewit, and Sempra Energy. He is a frequent speaker and writer on legal issues of concern to the construction industry. He is a member of the DRB Foundation, the ABA's Forum on Construction Law, and the International Bar Association. He has the highest rating from Martindale Hubbell (AV), has been named a “California Super Lawyer,” and is listed by Chambers USA. Mr. McMillan graduated first in his class, summa cum laude, from both Loyola Law School (JD 1987) and Loyola Marymount University (BS 1983). He clerked with Charles Clark, Chief Judge, United States Court of Appeals, Fifth Circuit.
