Die Arbeit beschäftigt sich mit der Frage, ob die Außengesellschaft bürgerlichen Rechts Inhaberin einer Marke sein kann. Ausgehend von der Entwicklung der (Teil-)Rechtsfähigkeit der Außen-GbR werden zunächst die Folgen dieser Entwicklung untersucht. Im Anschluss werden Alternativkonstruktionen zu einer markenrechtsfähigen GbR auf ihre Praxistauglichkeit hin überprüft. Abschließend wird auf die Frage eingegangen, ob ein europarechtliches Erfordernis für eine Anerkennung der Markenrechtsfähigkeit der Außen-GbR besteht.
